These Terms of Use apply to Steady Homework (homework.steadymindslearning.com.au), operated by Steady Minds Learning Pty Ltd in Perth, Western Australia.

1. What this tool is

Steady Homework provides general homework strategies, tools and worksheets for parents and guardians. It's free to use and doesn't require an account.

By using Steady Homework, including its strategies, Toolbox tools and worksheets, you agree to these Terms. You're free to stop using it at any time.

2. Not professional advice

Everything in this tool is general information only. It isn't educational, medical, psychological, or legal advice, isn't a diagnosis or assessment, and isn't a substitute for advice about your individual child from a qualified professional. While we take reasonable care to keep this tool accurate and useful, we don't warrant that its content is complete, current, or error-free, and we don't guarantee that any strategy or tool will resolve a particular issue for your child.

3. Who it's for

This tool is intended for use by parents and guardians on behalf of their child, not for direct, unsupervised use by children. We don't engage directly with students.

4. Acceptable use

You agree not to misuse Steady Homework, including attempting to disrupt or interfere with how it works, scraping or systematically copying its content, or using its content to build or supply a similar product or service.

5. Your information

No account is needed to use Steady Homework. Your homework selections, any learning profile you choose, and information you enter into the in-app tools stay on your device. We don't receive, store, or have access to that information.

If you choose to sign up for occasional emails, we collect your email address and consent information for that purpose. Your homework selections, learning profile and information entered into the in-app tools aren't sent with your email address.

We use Brevo to manage and send opted-in emails. You can unsubscribe at any time using the link in those emails. More information about how we handle personal information is in our Privacy Policy.

6. Intellectual property

All content in Steady Homework, including its strategies, tools, worksheets and branding, is owned by or licensed to Steady Minds Learning and is protected by applicable intellectual property laws.

You may use and print the strategies, tools and worksheets for your own family's personal use. You may not reproduce, republish, sell, commercially distribute, or use the content to build or supply a similar product or service without our permission.

7. External links and third-party services

Steady Homework links to or uses third-party services for functions such as appointment booking and email delivery. Those services have their own terms and privacy practices. We're not responsible for the content or privacy practices of third-party websites you choose to visit.

8. No warranty; limitation of liability

This tool is provided "as is," without warranty of any kind, to the extent permitted by law. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded. To the extent the law allows, Steady Minds Learning is not liable for any loss arising from your use of, or reliance on, this tool.

9. Not for emergencies

This tool isn't a crisis or emergency service. If you or your child are in immediate danger or need urgent support, contact 000 (Australia) or an appropriate crisis service.

This Privacy Policy explains how Steady Homework (homework.steadymindslearning.com.au) handles personal information. It sits alongside our main Privacy Policy, which covers our other services.

We are committed to protecting your privacy and handling personal information responsibly. We use the Australian Privacy Principles (APPs) as the basis for our privacy practices.

1. What stays on your device

Your homework selections, any learning profile you choose, and information you enter into the in-app tools stay on your device. We don't receive, store, or have access to that information.

2. What we collect if you choose to sign up

If you sign up for occasional emails, we collect your email address and a consent record containing the date and time, consent wording version, sign-up source and purpose. We don't send your homework selections, learning profile or information entered into the in-app tools with your email address.

Our emails use Brevo's anonymous email tracking, which counts how many emails are opened and links clicked in total, without linking that activity to your contact record. Links in our emails may pass through Brevo's tracking links.

Our hosting provider may also automatically process standard technical information about visits to the site, such as your IP address, as part of operating and securing the website.

3. How we use it

We use your email address to send you the occasional emails you signed up for and the resource you requested, and we keep the consent record as evidence of your consent. When you sign up, we email you a link to confirm your subscription. Please click it to complete your sign-up.

4. Retention

We keep your email address while you're subscribed. If you unsubscribe, we keep your email address on a do-not-email list with our email provider so we don't email you again, and we may keep the associated consent record for a reasonable period where needed for legal or record-keeping purposes. You can also contact us to ask about deletion of personal information we hold about you.

Our hosting provider (Netlify) may also keep standard technical request logs, including IP addresses, as part of running its service. These are held under its own retention settings, separate from anything we store ourselves.

5. Security

We take reasonable steps to protect the information we hold, including restricting access to authorised individuals only and using secure, access-controlled systems for anything we retain.

6. Who we share it with

Sign-up details are sent to our own sign-up service, which passes them to Brevo, which we use to manage and send opted-in emails. Brevo receives your email address and the consent information needed for the mailing list, and sends you the email asking you to confirm. Your homework selections, learning profile and information entered into the in-app tools aren't sent to Brevo or anyone else. We don't sell your personal information, and we don't send it to your child's school.

7. Overseas processing

We use service providers that may process personal information outside Australia.

Netlify, which hosts Steady Homework, is based in the United States and may process technical information about visits to the site outside Australia.

Our sign-up service runs on Netlify, our hosting provider, and may process sign-up details in the United States before they are passed to Brevo.

Brevo manages our opted-in email list. Brevo stores its main databases in the European Union, including France, Germany and Belgium.

We take reasonable steps when choosing and using service providers to protect the personal information we give them and to follow the Australian Privacy Principles as a matter of good privacy practice.

8. Cookies and analytics

Steady Homework doesn't use analytics, advertising or tracking cookies. Our main Steady Minds Learning website is separate and has its own privacy practices, described in our main Privacy Policy.

9. Access, correction and complaints

Contact us below to ask what personal information we hold about you, correct it, delete it, or raise a privacy concern. We will take privacy concerns seriously and aim to respond promptly. If a data breach involving your personal information is likely to cause serious harm, we'll use the Notifiable Data Breaches scheme as a guide to how we assess and respond to it.

10. Children's privacy

Steady Homework is designed for parents and guardians. We don't ask children to create an account or provide us with personal information. Homework selections, learning profile choices and information entered into the in-app tools stay on the device and aren't sent to us.
